These Terms of Service ("Terms") govern your access to and use of the RunMyReturn.com website, application, and related services (collectively, the "Service"), owned and operated by Run My Return, L.L.C., a North Carolina limited liability company ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Service Description

RunMyReturn.com provides real estate investment analysis and forecasting tools, including AI-generated projections, based on user-provided inputs and market data. The Service operates on a credit-based model, where credits may be purchased via Stripe or other payment providers to perform additional searches or analyses.

The Service is intended for informational and educational purposes only. It does not constitute financial, investment, legal, or tax advice and should not be relied upon as such.

2. Financial Projections and Disclaimers

2.1 Nature of Our Service

RunMyReturn provides informational tools and estimates to help you evaluate potential real estate investments. Our platform generates projections including but not limited to:

Net Present Value (NPV) calculations
Internal Rate of Return (IRR) estimates
Cash flow projections (5-year, 10-year, 30-year)
Average Daily Rate (ADR) forecasts
Occupancy rate estimates
Expense and income projections
Monte Carlo simulation outcomes

2.2 ESTIMATES ONLY - NOT GUARANTEES

ALL PROJECTIONS, FORECASTS, AND FINANCIAL ESTIMATES PROVIDED BY THIS SERVICE ARE ESTIMATES ONLY. They are based on:

Historical data that may not reflect future conditions
Assumptions about market conditions, interest rates, and rental demand
Third-party data from sources including Zillow and Airbnb that may be incomplete, outdated, or inaccurate
Statistical models that have inherent limitations and error margins

Actual investment returns may differ significantly from our projections, including the possibility of total loss of your investment.

2.3 NOT FINANCIAL, INVESTMENT, LEGAL, OR TAX ADVICE

Nothing on this platform constitutes:

Financial advice or recommendation to buy, sell, or hold any property

2.5 Your Acknowledgment

By using this Service, you expressly acknowledge and agree that:

You understand all projections are estimates only
You will NOT rely solely on our projections for investment decisions
You will conduct your own independent due diligence

You accept full responsibility for your investment decisions
Past performance of similar properties does not guarantee future results

2.6 Model Limitations

Our predictive models do NOT account for:

Future changes in zoning laws, regulations, or property taxes
Natural disasters, environmental hazards, or climate risks
Neighborhood crime rates, school quality changes, or demographic shifts
Economic recessions, market crashes, or interest rate fluctuations
Property-specific issues such as structural problems or deferred maintenance
Tenant quality, vacancy periods, or collection difficulties
Changes in short-term rental regulations or platform policies
Competition from new rental properties in the area

2.7 Third-Party Data

We rely on third-party data sources including but not limited to Zillow, Airbnb, and public records. We do not verify the accuracy of this data and cannot guarantee that it is current, complete, or correct. You should independently verify all property information before making investment decisions.

3. Waiver of Reliance

3.1 Express Waiver

YOU EXPRESSLY WAIVE ANY CLAIM THAT YOU RELIED ON ANY PROJECTION, FORECAST, ESTIMATE, OR ANALYSIS PROVIDED BY THIS SERVICE IN MAKING AN INVESTMENT DECISION.

3.2 No Fiduciary Relationship

No fiduciary, advisory, or professional relationship is created between you and RunMyReturn by your use of this Service. We owe you no duty of care beyond providing the Service as described in these Terms.

3.3 Your Independent Decision

Any investment decision you make is your own independent decision, made after your own independent analysis and due diligence, and is not based on any representation, warranty, or guarantee made by RunMyReturn.

3.4 Assumption of Risk

Real estate investment involves substantial risk, including the risk of losing your entire investment. By using this Service, you acknowledge that you understand and accept these risks. You agree that RunMyReturn is not responsible for any investment losses you may incur.

4. Your Responsibilities

4.1 Accuracy of Your Inputs

You are solely responsible for the accuracy of all information you provide to the Service, including but not limited to:

Property details and characteristics
Financial assumptions and parameters
Investment goals and risk tolerance

Inaccurate or incomplete inputs will result in inaccurate outputs. We are not responsible for any losses resulting from your provision of incorrect information.

4.2 Due Diligence

You agree to conduct your own independent due diligence before making any investment decision, including:

Physical inspection of the property
Review of title and ownership records
Verification of rental income and expense history
Research of local market conditions and trends
Review of applicable laws and regulations

4.3 Professional Advice

You agree to seek and rely upon the advice of qualified professionals for financial, legal, and tax matters related to real estate investment.

5. Accounts

You must be at least 18 years old to create an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
We reserve the right to suspend or terminate accounts for violation of these Terms.

6. Credits and Payments

Credits may be purchased through Stripe or other authorized payment processors.
All sales of credits are final; credits are non-refundable and non-transferable unless otherwise required by law.
Credits expire 12 months after purchase, if not used.
If your account is terminated for violation of these Terms, unused credits are forfeited.

7. User Data & AI Model Training

You grant the Company a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, distribute, and create derivative works from your submitted data, inputs, search queries, assumptions, and usage patterns ("User Data") for:
- Operating and improving the Service
- Training, testing, and refining AI models
- Creating aggregated or anonymized datasets that may be shared with or served to other users
We may incorporate your User Data into a generalized database for benchmarking, forecasting, and other product features.
You represent that you have all necessary rights and permissions to provide such User Data to us.

8. Intellectual Property

All content, software, and features of the Service are the property of the Company or its licensors and are protected by intellectual property laws.
You may not copy, modify, reverse engineer, or create derivative works of the Service without our prior written consent.

9. Acceptable Use

You agree not to:

Use the Service for unlawful, fraudulent, or abusive purposes
Attempt to gain unauthorized access to the Service or its data
Interfere with or disrupt the Service's operation

10. No Warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including accuracy, reliability, merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that forecasts or projections will be accurate or achieve any particular result.

11. Limitation of Liability

11.1 Maximum Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF RUNMYRETURN, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES, FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, SHALL NOT EXCEED THE GREATER OF:

THE TOTAL AMOUNT YOU HAVE ACTUALLY PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR
ONE HUNDRED DOLLARS ($100.00)

11.2 Exclusion of Certain Damages

IN NO EVENT SHALL RUNMYRETURN BE LIABLE FOR:

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
INVESTMENT LOSSES OR DIMINUTION IN PROPERTY VALUE
LOSSES ARISING FROM YOUR RELIANCE ON ANY PROJECTION OR ESTIMATE
DAMAGES ARISING FROM INACCURATE THIRD-PARTY DATA
DAMAGES RESULTING FROM DECISIONS MADE BASED ON SERVICE OUTPUT

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.3 Investment Loss Disclaimer

YOU EXPRESSLY AGREE THAT RUNMYRETURN SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY INVESTMENT LOSSES YOU MAY INCUR, REGARDLESS OF WHETHER SUCH LOSSES ARISE FROM YOUR USE OF OUR SERVICE, RELIANCE ON OUR PROJECTIONS, OR ANY OTHER CAUSE.

11.4 Basis of the Bargain

The limitations of liability set forth in this Section reflect the allocation of risk between you and RunMyReturn and are an essential basis of the bargain between us. RunMyReturn would not provide the Service without these limitations.

11.5 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights. In such jurisdictions, our liability will be limited to the maximum extent permitted by applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination:

Your license to use the Service will end immediately
Unused credits will be forfeited unless required by law
Sections 4, 5, 7, 8, 9, and 12 will survive termination

14. Force Majeure

We are not responsible or liable for any delay or failure in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet or utility failures, or governmental actions.

15. Dissolution & Liquidation

If the Company ceases operations, files for bankruptcy, or dissolves:

All outstanding credits will expire without refund unless required by law
We may delete or anonymize all stored User Data in our sole discretion, except as required by law to retain

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles.

Any legal action or proceeding will be brought exclusively in the state or federal courts located in Wake County, North Carolina.

17. Changes to Terms

We may update these Terms at any time by posting the revised version on the Service. Continued use after changes constitutes acceptance of the revised Terms.
